Boyce (District 43, Baltimore City) again to introduce the Solid Waste Disposal Surcharge and Wasted Food Reduction and Diversion Fund and Grant Programs Bill (<\/span><a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB0042?ys=2025RS\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">HB 42<\/span><\/a><span style=\"font-weight: 400;\">) for Maryland\u2019s 2025 legislative session. The bill was cross-filed in the Senate (<\/span><a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/SB0134?ys=2025RS\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">SB 134<\/span><\/a><span style=\"font-weight: 400;\">) by Senator Katie Fry Hester (District 9, Howard and Montgomery Counties). 2025 was this bill\u2019s fourth round in the Maryland legislature. Earlier versions of this bill included <\/span><a href=\"https:\/\/ilsr.org\/maryland-hb1070\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">HB1070<\/span><\/a> (2022)<span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/ilsr.org\/articles\/maryland-hb1139-2023\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">HB1139<\/span><\/a> (2023)<span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/ilsr.org\/articles\/maryland-hb1318-2024\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">HB1318<\/span><\/a> (2024)<span style=\"font-weight: 400;\">.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">In Maryland, the grants could total more than $14 million per year to support local governments, small businesses, non-profits, farmers, schools, <\/span><a href=\"https:\/\/docs.google.com\/document\/d\/1eG4ZAfDmKhOfVNaTDx1TAnt9alwiaUuJIVv2UPesBN8\/edit?usp=sharing\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">and more<\/span><\/a><span style=\"font-weight: 400;\"> in their efforts to advance wasted food prevention, rescue, recycling, and composting projects and infrastructure.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The bill addressed the critical need for investment into wasted food reduction and recovery programs and infrastructure in Maryland by establishing major grant funding programs funded by a nominal $2\/ton surcharge on waste disposal. <\/span><a href=\"https:\/\/ilsr.org\/disposal-surcharges-fund-composting\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Numerous other states<\/span><\/a><span style=\"font-weight: 400;\">, such as those featured in our <\/span><a href=\"https:\/\/ilsr.org\/webinar-disposal-surcharges\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">2022 webinar<\/span><\/a><span style=\"font-weight: 400;\">, have similar successful funding programs in place with positive impacts on their local communities, economies, and the environment.<\/span>\r\n\r\nDuring the 2025 session, this bill was supported by many organizations, groups, and legislators. The opposition, composed solely of the solid waste and hauling industry, strongly opposed the disposal surcharge funding mechanism. The House passed a version of HB42 that removed the surcharge funding mechanism and replaced it with a 5 years of funding, at the discretion of the Governor each year. Expanded processing capacity is needed to meet food waste diversion goals and, without this support for community-oriented and farm projects, Maryland will miss out on this opportunity to support local economies and keep organic materials circulating within Maryland\u2019s many diverse communities.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A major obstacle to development and expansion of food waste reduction, rescue, and diversion infrastructure and programs is lack of funding.\u00a0<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Maryland Food Systems Resiliency Council\u2019s <\/span><a href=\"https:\/\/mdem.maryland.gov\/Food%20Security%20Council%20Minutes\/2024%20FSRC%20Report%20-%20Final%20%5b8.7.24%5d.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">2024 report to the General Assembly<\/span><\/a><span style=\"font-weight: 400;\"> calls for investment in cold storage, organics recycling of food residuals, food residual diversion sites and programs, and education and technical assistance to support reduction of food waste, funded by a disposal surcharge.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Maryland has passed numerous policies supporting healthy soils, food waste recovery, recycling, and composting but funding to support effective development of these efforts is sorely lacking. A nominal per-ton waste surcharge will provide funding to support and expand food waste reduction and diversion throughout the state while also disincentivizing final solid waste disposal in landfills and incinerators.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Expansion of composting and organics recycling infrastructure and the availability of high-quality, non-contaminated compost is crucial to <\/span><a href=\"https:\/\/www.iwla.org\/docs\/default-source\/conservation-docs\/agriculture-documents\/via-2021-carbon-sequestration-report-final_lowres.pdf?sfvrsn=2bb28e0d_12\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">supporting Maryland soils<\/span><\/a><span style=\"font-weight: 400;\"> by reducing the need for synthetic fertilizers, increasing soil organic matter, and improving water and nutrient cycling.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A <\/span><a href=\"https:\/\/environmentalintegrity.org\/wp-content\/uploads\/2021\/06\/MD-Landfill-Methane-Report-6.9.2021-unembargoed_with-Attachments.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">2021 report<\/span><\/a><span style=\"font-weight: 400;\"> revealed that Maryland landfills were emitting four times more methane than previously estimated. Diverting organic waste from landfills, where anaerobic decomposition produces methane, a potent greenhouse gas, is a necessity for Maryland to achieve <\/span><a href=\"https:\/\/mde.maryland.gov\/programs\/air\/ClimateChange\/Documents\/MARYLANDS%20PATHWAY%20REPORT%20AND%202031%20GHG%20PLAN\/Maryland%27s%20Climate%20Pathway%20Report.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">its goals<\/span><\/a><span style=\"font-weight: 400;\"> of 60% emissions reductions by 2031 and net-zero in 2045.<\/span><\/li>\r\n<\/ul>\r\n<h3><b>Bill Refinements Since 2022<\/b><\/h3>\r\n<span style=\"font-weight: 400;\">Since the bill\u2019s first introduction in the 2022 session, there have been a number of changes based on conversations with numerous stakeholders to address their concerns and\/or suggestions to improve this bill. The Institute for Local Self-Reliance (ILSR) has gathered input from numerous stakeholders in order to tailor this bill to fit Maryland\u2019s unique landscape. Some of these stakeholders include the Maryland Association of Counties, Prince George\u2019s County Department of the Environment, Maryland Clean Water Action, US Composting Council\u2019s Maryland-DC Chapter, and others. ILSR collaborated extensively with the Maryland Department of Environment and Department of Agriculture to ensure the bill fills programmatic gaps and is implementable by the agencies.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">\u00a0As a result of these collaborations, major changes include:\u00a0<\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Dropping the per-ton surcharge on waste landfilled or incinerated from an original $5\/ton to $2\/ton.\u00a0<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Focusing resources specifically on food waste reduction and diversion.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Allocating 50% of funding as block grants to Counties (including Baltimore City and the Mid-Shore), distributed annually in amounts proportional to each County\u2019s population, for expenditure on projects that reduce, reuse, and divert wasted food.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Allocating the remaining funding equally between the Wasted Food Reduction Grant Program (administered by MDE) and the On-Farm Organics Diversion Grant Program (administered by MDA).<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Increasing the limit on funding to be used for administrative costs for all grants programs from 10% to 25%.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Updating the implementation timeline to better align with existing agency processes and to allow for the agencies to avoid out-of-pocket costs when setting up the grant programs.<\/span><\/li>\r\n<\/ul>\r\n<h2>Status Updates:<\/h2>\r\n<ul>\r\n \t<li>HB 42 was heard in the House Committee on Environment and Transportation on January 29th. <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Committees\/Media\/false?cmte=ent&amp;clip=ENV_1_29_2025_meeting_2&amp;ys=2025rs\" target=\"_blank\" rel=\"noopener\">Watch the recording here<\/a>.<\/li>\r\n \t<li>SB 134 was heard in the Senate Committee on Education, Energy, and the Environment on February 11th. <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Committees\/Media\/false?cmte=eee&amp;ys=2025RS&amp;clip=EEE_2_11_2025_meeting_1&amp;billNumber=sb0134\" target=\"_blank\" rel=\"noopener\">Watch the recording here<\/a>.<\/li>\r\n \t<li><a href=\"https:\/\/ilsr.org\/wp-content\/uploads\/2025\/01\/ILSR-SB134-Sign-On-Testimony-FAV.pdf\" target=\"_blank\" rel=\"noopener\">ILSR's testimony letter<\/a> received 44 organizational sign-ons.<\/li>\r\n<\/ul>\r\n<a class=\"synved-social-button synved-social-button-share synved-social-size-16 synved-social-resolution-single synved-social-provider-facebook nolightbox\" style=\"font-size: 0px;
