ILSR worked with the bill sponsor, Jamie Raskin, on the compost procurement pieces of the bill and on language that would have required evaluation of the process to eliminate polystyrene foodservice ware. That first step toward eliminating the state government\u2019s use of polystyrene was removed from the bill due to pushback from industry. ILSR Composting for Community Director Brenda Platt testified in favor of the bill at its hearing."},{"title":"2011: Composting Outreach and Study Group","text":"In 2011, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Search\/Legislation?target=\/2011rs\/billfile\/hb0817.htm\" target=\"_blank\" rel=\"noopener\">House Bill 817<\/a> pushed the state to improve its outreach to promote composting and established a study group to report on the state\u2019s existing composting policy landscape and make recommendations. Brenda Platt, as Composting for Community Director, worked directly with her local delegate at the time, Heather Mizeur, to create this bill to address the longtime need for more clarity and information on composting in Maryland. When the bill passed, ILSR participated in the study group that produced the January 2013 report to the General Assembly, <a href=\"https:\/\/mde.maryland.gov\/programs\/land\/RecyclingandOperationsprogram\/Documents\/Publications\/composting_workgroup_final_report_1-2013000%20%281%29.pdf\" target=\"_blank\" rel=\"noopener\"><i>Composting Workgroup Final Report<\/i><\/a>. In addition to providing a recommended list of people to be involved in that study group, ILSR played a pivotal role in shaping the report\u2019s recommendations."},{"title":"2013: Permitting for Composting Facilities ","text":"In 2013, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB1440\/?ys=2013rs\" target=\"_blank\" rel=\"noopener\">House Bill 1440<\/a> required the establishment of a permit system tailored to composting facilities. ILSR also succeeded in including permit exemptions for certain <a href=\"https:\/\/dsd.maryland.gov\/regulations\/Pages\/26.04.11.06.aspx\" target=\"_blank\" rel=\"noopener\">on-farm<\/a> and small-sized composting operations."},{"title":"2014: State Highway Administration Compost Procurement","text":"In 2014, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB0878\/?ys=2014rs\" target=\"_blank\" rel=\"noopener\">House Bill 878<\/a> required the State Highway Administration to procure compost and compost-based products for use in highway landscaping and construction projects as an erosion mitigation and stormwater management strategy. ILSR worked with the House bill\u2019s sponsor, Delegate Dana Stein, and the State Highway Administration to work out amendment language that aligned compost use with existing Maryland erosion control standards and stormwater management practices and that highlighted specific uses for compost in highway construction products."},{"title":"2017: Labeling Standards for Compostables and Biodegradables","text":"In 2017, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/legislation\/details\/hb1349?ys=2017rs\" target=\"_blank\" rel=\"noopener\">House Bill 1349<\/a> established needed standards by which plastic products can be labeled as compostable or biodegradable. ILSR <a href=\"https:\/\/ilsr.org\/articles\/compostable-plastics-bill-advances-in-maryland\/\" target=\"_blank\" rel=\"noopener\">led the coalition<\/a> that crafted this bill, working closely with the bill\u2019s sponsor, Delegate Shane Robinson, and incorporating lessons learned from a similar California law. ILSR submitted <a href=\"https:\/\/ilsr.org\/wp-content\/uploads\/2017\/03\/ILSR-testimony-HB-1349-03-01-17.pdf\" target=\"_blank\" rel=\"noopener\">favorable written testimony<\/a> and organized the expert panel to testify. HB 1349 was <a href=\"https:\/\/ilsr.org\/articles\/press-release-maryland-governor-hogan-signs-ilsr-led-bipartisan-bills-to-advance-composting\/\" target=\"_blank\" rel=\"noopener\">highlighted<\/a> as one of 12 key environmental bills signed by the Governor at the Annapolis City Dock."},{"title":"2017: Organic Material Diversion and Infrastructure Study Group","text":"Also in 2017, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB0171?ys=2017rs\" target=\"_blank\" rel=\"noopener\">House Bill 171<\/a> launched a <a href=\"https:\/\/mde.maryland.gov\/programs\/LAND\/RecyclingandOperationsprogram\/Pages\/House-Bill-171-%E2%80%93-Organic-Materials-Diversion-and-Infrastructure-%E2%80%93-Study.aspx\" target=\"_blank\" rel=\"noopener\">study group<\/a> to evaluate and make recommendations regarding organic material diversion and infrastructure needs in Maryland. The bill named ILSR as a member of the study group and Composting for Community Director Brenda Platt heavily participated in meetings and report writing for a year and a half up to the release of the <a href=\"https:\/\/mde.maryland.gov\/programs\/LAND\/RMP\/Documents\/HB%20171%20final%20report.pdf\" target=\"_blank\" rel=\"noopener\">Final Report<\/a> in 2019. The report\u2019s key findings and recommendations have influenced the state\u2019s direction on organics diversion infrastructure and programs."},{"title":"2021: Food Residual Diversion Requirement for Large Food Waste Generators","text":"In 2021, <a href=\"https:\/\/ilsr.org\/articles\/maryland-organics-recycling\/\" target=\"_blank\" rel=\"noopener\">House Bill 264<\/a> established Maryland\u2019s food residuals diversion requirement for large food waste generators (LFWGs). The law, sponsored by Delegate Lorig Charkoudian, requires institutions producing more than one ton of food residuals per week to divert those materials from disposal if capacity exists within a 30-mile radius. The bill is designed to stimulate in-state investment in organics processing infrastructure. ILSR was a key driver of the <a href=\"https:\/\/ilsr.org\/articles\/new-maryland-composting-policies\/\" target=\"_blank\" rel=\"noopener\">seven-year process<\/a> leading up to the legislation\u2019s passage and took a leading role in drafting the bill language and organizing advocacy and testimony. We helped introduce the first version of this bill in 2014 (<a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/hb1081?ys=2014RS\" target=\"_blank\" rel=\"noopener\">HB 1081<\/a>). In 2015, the bill was reintroduced as a task force bill (<a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/hb0603?ys=2015RS\" target=\"_blank\" rel=\"noopener\">HB 603<\/a>) and again in 2016 (<a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB0743\/?ys=2016rs\" target=\"_blank\" rel=\"noopener\">HB 743<\/a>), neither of which passed. The task force bill morphed into the 2017 study group bill <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB0171?ys=2017rs\" target=\"_blank\" rel=\"noopener\">House Bill 171<\/a> (see above), achieving partial progress toward the ultimate goal of a food residuals diversion law. ILSR <a href=\"https:\/\/ilsr.org\/articles\/md-bill-food-scrap-recovery\/\" target=\"_blank\" rel=\"noopener\">worked heavily<\/a> on the 2020 version of the food scrap recovery bill (<a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/hb0589?ys=2020RS\" target=\"_blank\" rel=\"noopener\">HB 589<\/a>), which laid the penultimate steps for the 2021 bill\u2019s ultimate passage into law."},{"title":"2022: Grant Program for School Food Waste Reduction and Composting","text":"In 2022, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/SB0124?ys=2022RS&amp;search=True\" target=\"_blank\" rel=\"noopener\">Senate Bill 124<\/a> established a grant program for county boards and public schools to develop and implement food-waste-reduction and composting programs. ILSR <a href=\"https:\/\/ilsr.org\/articles\/maryland-compost-policy-2022\/\" target=\"_blank\" rel=\"noopener\">advised<\/a> both the Senate and House sponsors (Senator Shelly Hettleman and Delegate Lorig Charkoudian) on the language, defining which programs should be eligible for grant funding. We also provided input to the bill\u2019s <a href=\"https:\/\/ilsr.org\/wp-content\/uploads\/2022\/04\/FINAL.11.23.School-Composting-Fact-Sheet.pdf\" target=\"_blank\" rel=\"noopener\">factsheet<\/a> and <a href=\"https:\/\/mgaleg.maryland.gov\/cmte_testimony\/2022\/ehe\/1q08ndFvaUkwJq001ccUyKDmoBxgy8Uzg.pdf\" target=\"_blank\" rel=\"noopener\">testified in favor<\/a> of the bill."},{"title":"2023: Expansion of On-Farm Food Scrap Composting Permit Exemption","text":"In 2023, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB0253?ys=2023RS&amp;search=True\" target=\"_blank\" rel=\"noopener\">House Bill 253<\/a> was passed, doubling the area allowed for on-farm food scrap composting under <a href=\"https:\/\/ilsr.org\/articles\/maryland-permit-exemptions\/\" target=\"_blank\" rel=\"noopener\">Maryland\u2019s on-farm composting permit exemption<\/a>. The bill was first introduced in 2022 as <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/SB0229\" target=\"_blank\" rel=\"noopener\">SB 229<\/a>. ILSR led the bill language development process in 2022, <a href=\"https:\/\/ilsr.org\/articles\/bill-expanding-on-farm-composting-of-food-scraps-passes-in-md\/\" target=\"_blank\" rel=\"noopener\">working closely<\/a> with the bill sponsors (including Delegate Emily Shetty and Senator Jason Gallion) and coordinating input from the farming and environmental communities, such as the University of Maryland Extension. The 2023 language amendment and advocacy process was led by <a href=\"https:\/\/cleanwater.org\/2023\/04\/05\/expanding-farm-compost\" target=\"_blank\" rel=\"noopener\">Maryland Clean Water Action<\/a> and an active group of stakeholders that included ILSR, the <a href=\"https:\/\/mdfarmbureau.com\/\" target=\"_blank\" rel=\"noopener\">Maryland Farm Bureau<\/a>, a <a href=\"https:\/\/www.delmarvanow.com\/story\/news\/local\/maryland\/2023\/04\/10\/how-new-maryland-composting-bills-could-give-farmers-big-green-boost\/70076024007\/\" target=\"_blank\" rel=\"noopener\">local farmer<\/a>, and a <a href=\"https:\/\/compostcrew.com\/\" target=\"_blank\" rel=\"noopener\">local community composter<\/a>, all of whom were also involved in 2022."},{"title":"Still to Come: Grant Program Funded by Waste Disposal Surcharge","text":"Starting in the 2022 legislative session, ILSR worked closely with Delegate Regina T. Boyce to draft and introduce a bill addressing the critical need for investment in wasted food reduction and composting programs and infrastructure by establishing major grant funding via a surcharge on waste disposal. Versions of this bill were introduced in <a href=\"https:\/\/ilsr.org\/articles\/maryland-hb1070\/\" target=\"_blank\" rel=\"noopener\">2022<\/a>, <a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/HB1139?ys=2023RS\" target=\"_blank\" rel=\"noopener\">2023<\/a>, and <a href=\"https:\/\/ilsr.org\/articles\/maryland-hb1318-2024\/\" target=\"_blank\" rel=\"noopener\">2024<\/a>, with the 2024 version (<a href=\"https:\/\/mgaleg.maryland.gov\/mgawebsite\/Legislation\/Details\/hb1318?ys=2024RS\" target=\"_blank\" rel=\"noopener\">HB1318<\/a>) making the most progress in the legislature. ILSR has provided written and oral testimony at the bill hearings each year and ILSR\u2019s <a href=\"https:\/\/ilsr.org\/wp-content\/uploads\/2024\/02\/ILSR-HB1318-Sign-On-Testimony-FAV.pdf\" target=\"_blank\" rel=\"noopener\">2024 testimony<\/a> included 30 organizational sign-ons. ILSR worked in close partnership with Roger Berliner (County Council Vice President at the time) and the Montgomery County Food Council on the bill and Strategic Plan and testified in favor of the bill at its hearing. The Plan stipulates a diverse and distributed approach to food rescue, at-home and community-scale composting, and local compost use.
