This updated exemption more than doubles the area that may be used for on-farm composting: farms utilizing 10,000 sq.ft. or less for the active composting process, not including area for storage of materials or finished compost, are exempt from obtaining a <a href=\"https:\/\/mde.maryland.gov\/programs\/land\/RecyclingandOperationsprogram\/Documents\/Composting%20Facility%20Permitting%20Guidance.pdf\" target=\"_blank\" rel=\"noopener\">composting facility permit<\/a>. Development and operation of an on-farm composting facility processing off-site food scraps that exceeds this threshold is required to operate under a composting facility permit (<a href=\"https:\/\/dsd.maryland.gov\/regulations\/Pages\/26.04.11.06.aspx\" target=\"_blank\" rel=\"noopener\">COMAR 26.04.11.06<\/a>).\r\n\r\n&nbsp;\r\n<h2><b>Other Exemptions for On-Farm Composting<\/b><\/h2>\r\nIn Maryland, certain farms that compost various materials are exempt from obtaining a permit, including:\r\n<ul>\r\n \t<li aria-level=\"1\">Farms that only process materials from on site and uses all compost on site, regardless of area used;<\/li>\r\n \t<li aria-level=\"1\">Farms that only process on-site materials and off-site yard waste, manure, or animal bedding within 40,000 sq.ft., with appropriate management plans; and<\/li>\r\n \t<li aria-level=\"1\">Emergency composting of on-site animal mortalities.<\/li>\r\n<\/ul>\r\nThe addition of food scraps from off site necessitates stricter guidelines for on-farm composting, so the on-farm composting permit exemption updated by <a href=\"https:\/\/mgaleg.maryland.gov\/2023RS\/bills\/sb\/sb0262t.pdf\">SB262<\/a>\/<a href=\"https:\/\/mgaleg.maryland.gov\/2023RS\/bills\/hb\/hb0253e.pdf\">HB253<\/a> outlines specific best management practices that must be implemented to qualify for this exemption. This permit exemption allows greater flexibility for farm composting sites to diversify their composting recipes with off-site food scraps and support local organic waste diversion.\r\n\r\n&nbsp;\r\n<h2><b>On-Farm Food Scrap Composting Permit Exemption<\/b><\/h2>\r\nFarms that compost \u201ctype 2 feedstocks\u201d generated off-site qualify for the permit exemption, as long as the on-farm compost sites uses 10,000 sq.ft. or less for active composting and only compost the following materials:\r\n<ul>\r\n \t<li aria-level=\"1\">Organic materials generated on-site, including animal manure and bedding,<\/li>\r\n \t<li aria-level=\"1\">\u201cType 1 feedstock\u201d generated on- or off-site,\r\n<ul>\r\n \t<li aria-level=\"2\">\u201cType 1 feedstocks\u201d include yard waste or other safe materials as determined by the Department of Environment<\/li>\r\n<\/ul>\r\n<\/li>\r\n \t<li aria-level=\"1\">\u00a0\u201cType 2 feedstocks\u201d generated on-site,\r\n<ul>\r\n \t<li aria-level=\"2\">\u201cType 2 feedstocks\u201d include source-separated organics (including food scraps and nonrecyclable paper) as well as approved animal manure and bedding<\/li>\r\n<\/ul>\r\n<\/li>\r\n \t<li aria-level=\"1\">Off-site, non-contaminated \u201ctype 2 feedstock\u201d that are properly stored and incorporated into the composting process within 24 hours of receipt.<\/li>\r\n<\/ul>\r\nExempt on-farm composting facilities must also keep records of the arrival and processing of off-site \u201ctype 2 feedstocks\u201d including food scraps.\r\n\r\n&nbsp;\r\n<h2><b>Reporting the Impact of On-Farm Composting<\/b><\/h2>\r\nAs provisioned by this bill, the Department of Environment will produce a report by December 1, 2028 that encompasses the impacts of on-farm composting sites in Maryland.\r\n<h6>\u201c(4) On or before December 1, 2028, the Department shall submit a report, in accordance with \u00a7 2\u20131257 of the State Government Article, to the General Assembly that analyzes the impact of on\u2013farm composting facilities in Maryland, including:<\/h6>\r\n<h6>(i) The amount of food waste diverted from landfills;<\/h6>\r\n<h6>(ii) An estimate of the amount of finished soil amendment produced by on\u2013farm composting facilities operating under this section;<\/h6>\r\n<h6>(iii) Operational challenges experienced by on\u2013farm composting facilities;<\/h6>\r\n<h6>(iv) Violations and enforcement actions that have arisen as a result of the expansion of facilities under this section; and<\/h6>\r\n<h6>(v) Recommendations on the feasibility of expanding facilities to allow for up to 40,000 square feet to be used for food scrap composting activities.\u201d<\/h6>\r\nThis clause includes reporting on the feasibility of increasing the allowable non-permitted active on-farm composting area to be raised from 10,000 sq.ft. to 40,000 sq.ft.\r\n\r\n&nbsp;\r\n<h2><b>M\u00e1s
