These rules are found in The Iowa Administrative Code\u2019s <\/span><a href=\"https:\/\/www.legis.iowa.gov\/law\/administrativeRules\/chapters?agency=567\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Chapter 567<\/span><\/a><span style=\"font-weight: 400;\">, Environmental Protection Commission, \u201cOrganic Materials Composting Facilities.\" <\/span><span style=\"font-weight: 400;\">Permits such as requirements for permit applications, site analysis, and operational plans must be obtained from the Iowa Department of Natural Resources (IDNR). Some operations may be exempt from this permitting requirement, such as<\/span><span style=\"font-weight: 400;\"> certain small-sized, educational, or private composting operations.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">\u201cSmall compost facilities\u201d means facilities that receive a total of two tons or less per week of yard and organics waste for composting, meeting the requirements set forth in rule<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.5.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">567\u2014105.5(455B,455D)<\/span><\/a><span style=\"font-weight: 400;\">.<\/span>\r\n<h2><span style=\"font-weight: 400;\">Permit Exemptions<\/span><\/h2>\r\n<span style=\"font-weight: 400;\">The following composting operations are exempt from the requirements of Chapter 567, pursuant to <\/span><a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/09-26-2007.567.105.2.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">567\u2013105.2 (455B, 455D)<\/span><\/a><span style=\"font-weight: 400;\">:<\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Yard waste, household organics, and agricultural waste composted separately or in any combination and used on the same premises where they are generated.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Composting facilities involving agricultural waste\u2013excluding dead animals\u2013and clean wood waste as a bulking agent.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Yard waste, household organic waste, and agricultural waste generated, composted together on the same premises which they originated.<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400;\">Permit by Rule\u00a0<\/span><\/h2>\r\n<span style=\"font-weight: 400;\">Composting facilities <\/span><b>not<\/b><span style=\"font-weight: 400;\"> exempt pursuant to <\/span><a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/09-26-2007.567.105.2.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">567\u2013105.2 (455B, 455D)<\/span><\/a> <span style=\"font-weight: 400;\">may still be exempt from obtaining a solid waste permit if they follow certain requirements.\u00a0<\/span>\r\n\r\n<b>General requirements for all composting facilities not exempt pursuant to 567\u2014105.2(455B,455D) (<\/b><a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><b>105.3<\/b><\/a><b>)<\/b>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Yard waste facilities operating in conformance with specific regulations (section<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/09-26-2007.567.105.4.pdf\"><span style=\"font-weight: 400;\">105.4<\/span><\/a><span style=\"font-weight: 400;\">) plus location, management, and runoff requirements (section<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.3<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Small quantity solid waste compost operations (as defined in<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.5.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.5<\/span><\/a><span style=\"font-weight: 400;\">) operating in conformance with<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.3<\/span><\/a> <span style=\"font-weight: 400;\">y<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.5.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.5<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The compost facility should be 500 feet from any existing inhabited residence, not including the residence of the person owning\/operating the compost facility<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Composting must be done:<\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Outside of wetlands<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">At least 200 feet from public wells<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">100 feet from private wells<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">50 feet from property lines<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">100 feet from flowing or intermittent streams, lakes, or ponds<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">In a manner that minimizes the formation of leachate and with proper management of runoff from the composting facility\u00a0<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Requirements with legal notifications, signage, and operations (e.g., compliance, reporting, and record keeping with<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.3<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/li>\r\n<\/ul>\r\n<b>Specific requirements for yard waste composting facilities (<\/b><a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/09-26-2007.567.105.4.pdf\" target=\"_blank\" rel=\"noopener\"><b>105.4<\/b><\/a><b>)<\/b>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Yard waste facilities may be exempt if operating in conformance with requirements outlined in section<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/09-26-2007.567.105.4.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.4<\/span><\/a><span style=\"font-weight: 400;\">, including those related to legal notices, signage, size, operating conditions, and reporting.\u00a0<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Yard waste facilities operating in conformance with specific regulations (section<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/09-26-2007.567.105.4.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.4<\/span><\/a><span style=\"font-weight: 400;\">) plus location, management, and runoff requirements (section<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.3<\/span><\/a><span style=\"font-weight: 400;\">)<\/span><\/li>\r\n<\/ul>\r\n<b>Small composting facilities receiving off-premises materials (<\/b><a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.5.pdf\" target=\"_blank\" rel=\"noopener\"><b>105.5<\/b><\/a><b>)<\/b>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Small quantity solid waste compost operations (as defined in<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.5.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.5<\/span><\/a><span style=\"font-weight: 400;\">) operating in conformance with<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.3<\/span><\/a> <span style=\"font-weight: 400;\">y<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.5.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.5<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\r\n<\/ul>\r\n<b>Specific requirements for composting of dead farm animals (<\/b><a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.6.pdf\" target=\"_blank\" rel=\"noopener\"><b>105.6<\/b><\/a><b>)<\/b>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Facilities composting dead farm animals may be exempt if operating in conformance with requirements outlined in section<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.6.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.6<\/span><\/a><span style=\"font-weight: 400;\">, including if they are generated on-site, incorporated within 24 hours, and properly covered with <\/span><span style=\"font-weight: 400;\">bulking agents<\/span><span style=\"font-weight: 400;\"> to prevent pest access and odor.\u00a0<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Facilities composting dead farm animals operating in conformance with specific regulations (section <\/span><a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.6.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.6<\/span><\/a><span style=\"font-weight: 400;\">) plus location, management, and runoff requirements (section<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.3<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400;\">Receiving Off-Premises Materials<\/span><\/h2>\r\n<span style=\"font-weight: 400;\">The state\u2019s rules allow composters to accept up to two tons of food scraps per week from off-site generators without obtaining a solid waste permit, although they still must comply with site and operating requirements.<\/span>\r\n\r\n<span style=\"font-weight: 400;\">The following are some of the requirements regarding acceptable materials and amounts for small composting facilities exempt from obtaining a solid waste permit (provided the facility complies with<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.3.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.3(455B,455D)<\/span><\/a> <span style=\"font-weight: 400;\">y<\/span> <a href=\"https:\/\/www.legis.iowa.gov\/docs\/iac\/rule\/08-31-2016.567.105.5.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">105.5(455B,455D)<\/span><\/a><span style=\"font-weight: 400;\">):<\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Yard waste and food residuals may be received from off premises at a total rate of two tons or less per week for composting either singly, in combination, or with agricultural waste<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Any clean wood waste free of coating and preservatives may be used as a bulking agent<\/span>\r\n<ul>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Two tons per week combined weight limit does not apply to bulking agents<\/span><\/li>\r\n \t<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The amount of bulking agent received must be appropriate for the amount of compostable materials received<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<span style=\"font-weight: 400;\">The above does not apply if only agricultural wastes or only yard wastes are collected
